Once an appeal is filed, the zoning decision no longer rests with the Township. The Ontario Land Tribunal makes the final decision.
As part of the legal appeal process, lawyers for Wilmot Township and the Region of Waterloo considered all of the relevant technical findings as well as the community’s feedback in relation to the regulations under Ontario’s Aggregate Resources Act. After receiving legal advice, it was decided by Township Council that the best path forward for the Township was to resolve the appeal as per the Minutes of Settlement agreed to by the Township, the Region, and Jackson Harvest Farms Inc.
The Minutes of Settlement have now been provided to the Ontario Land Tribunal for its consideration. It will ultimately be up to the Tribunal to decide what happens next. The next meeting in relation to the appeal – referred to as a Case Management Conference – will be held on March 1, 2023. Once we learn of the Tribunal’s decision, we will share it with the community.
This application has been appealed to the Ontario Land Tribunal.
